Our client is a global law firm that seeks to recruit a Private Client lawyer on a six month fixed term contract to cover maternity leave. Joining an established team that acts for domestic and international clients the successful candidate will advise on the following: Wills and Lifetime Planning · Experience advising both UK domiciled and non-UK domiciled individuals on their estate planning in respect of their UK assets. · Basic understanding of UK/US estate planning and Private International Law is an asset. · Confident drafting various forms of Wills, incorporating trusts and other specific wishes. · Property Law knowledge and use of HM Land Registry's online portal is a bonus. Trusts · Comprehensive understanding of the various types of UK trusts and their respective tax treatment. · Good understanding of the lifecycle/administration of a trust, particularly in relation to the preparation and filing of IHT Returns within the Relevant Property Regime. · Experience in drafting various trust documentation, such as: trust deeds, deeds of appointment and trust tax returns. · Appreciation of the various trust powers (i.e. dispositive vs. administrative) and how each can be applied. Probate · Ability to manage the probate process from start to finish. · Experience in preparing complex IHT400 Returns for cross-border estates. · Good understanding of the UK concept of 'domicile' and how it is applied to cross-border estate administration. · Ability to read and prepare estate accounts. Powers of Attorney · Experience in drafting Lasting Powers of Attorney - Financial Decisions and Health and Care Decisions. · Appreciation of the difference between 'Preferences' and 'Instructions' and the ability to draft and advise on each. · Understanding of an attorney's duties under the Mental Capacity Act 2005. · Understanding of how foreign powers of attorney are treated in England & Wales and vice versa. Applications are sought from qualified lawyers who have upwards of four years' PQE. STEP qualification is an advantage but not essential. Candidates should have excellent communication skills and should have experience using PLC, Lexis and Lawtel.
